Dispute resolution or litigation?

Many clients ask “what is litigation”? The definition is “lawsuit” or “legal action”. Essentially, it is court proceedings that are used to resolve a dispute. Each case is different but generally proceedings should only normally be used as the last resort. “Dispute resolution” is far wider than court proceedings. A good dispute resolution lawyer (aka a “litigator”) should always be wise and look to combine the formalities of case work (even if a court claim has to be instigated) with a practical focus on resolution by agreement (settlement), even in the most hostile or difficult of cases.
